Everton’s deduction is a major event that could shake up City and Chelsea like an earthquake.

Everton has become the first team to face consequences for violating profitability and sustainability regulations, leaving other teams in anticipation of the future repercussions.

Geologists understand that on occasion, what may seem like an earthquake is actually just a precursor to a much larger seismic occurrence. It is essential to keep this in mind in light of Everton’s punishment of losing 10 points for violating the Premier League’s profit and sustainability rules (PSR). This is because Manchester City and Chelsea may be facing a significantly more significant and consequential event in the near future.

Over the course of several years, the City has faced over 100 violations of Premier League regulations. Chelsea is currently being investigated for suspected financial misconduct from 2012 to 2019. Recent revelations by the Guardian suggest that companies owned by Roman Abramovich may have made secret payments totaling tens of millions of pounds.
The league has handed down punishment to Everton for violating profitability and sustainability regulations, making them the first club to face such consequences. Renowned sports lawyer Catherine Forshaw predicts that City and Chelsea might face even harsher penalties, possibly including relegation.

“Forshaw, a lawyer at Brabners, a sports law firm who has advised national governing bodies and football clubs, expresses concern that the recent verdict will increase anxiety among lawyers at these clubs. He believes that there is now a precedent set, and considering the severity of the situation in comparison to Chelsea and Manchester City, Everton could potentially face relegation.”

Nii Anteson, a well-known sports lawyer, highlights sections 107 and 108 of the Everton verdict, which could possibly have significance for upcoming cases.
The commission made it clear to Everton that they had a significant duty to act honestly and sincerely. They also indicated that the information provided by the club was significantly incorrect and not completely truthful.
However, they did not agree with Everton’s representative’s argument that, like a tax accountant’s role is to minimize a client’s tax liability, part of his job was to safeguard or interpret PSR rules in favor of his employer.
Anteson, a partner and solicitor advocate at the law firm Sheridans, believes this is important in other instances as well. He explains that a representative stated their responsibility is to interpret profitability and sustainability rules in a way that benefits their employer, Everton. However, the commission in this particular situation determined that the overall duty of good faith that clubs owe to the Premier League is of utmost importance, surpassing any other considerations.

“In all honesty, the Premier League is not well-informed about the inner workings of a club, except for the financial reports that are required to be submitted. Therefore, it is crucial for clubs to exercise great caution while providing these reports. The commission discovered that Everton did not intentionally try to bypass the rules, but it did not fulfill its obligation to act in good faith, which contributed to making the situation worse.”

However, it should be noted that there were also factors that lessened the severity of the situation at Everton. As an example, the commission acknowledged that the club had been transparent and accountable when handling their financial challenges with the Premier League, and this commendable behavior should be taken into consideration.
The paragraph mentioned the impact of Covid-19 and other challenges that Everton had encountered during a specific time frame when their losses exceeded the limit of £105m within three years. Nonetheless, they were still subject to a 10-point deduction.

Everything important in City’s case is worth mentioning, particularly because they are being charged with several more offenses, such as not providing an accurate representation of the club’s financial situation, not disclosing complete information regarding player and manager payments, not adhering to fair play rules, and not cooperating with the Premier League’s investigation. They have denied any wrongdoing and claim to have substantial evidence supporting their stance.

Chelsea’s situation is once again unique, as a fresh management has taken over the club and is now bringing attention to the inconsistencies it discovered within the Premier League.

According to Anteson, there is a shared connection among these three cases. He states that the Premier League is now motivated to ensure that their rules and regulations have a strong impact as a deterrent.
Is the Premier League starting to show its strength? It’s a mixed answer, according to Forshaw. She mentions that the Premier League is keeping an eye on the independent regulator that will be implemented. Basically, the Premier League wants to maintain some of its powers to regulate their own league. This is a way for them to demonstrate that they can do so and will take any violations of the regulations seriously.

What is the expected outcome now? Everton have expressed their intention to challenge the penalty and the conclusion that they did not act in utmost good faith. However, both Anteson and Forshaw do not think they have a high probability of completely reversing the ruling.
According to Forshaw, it is possible that the punishment may be lessened, but only if it can be demonstrated that there was an unfair judgment or if some evidence was overlooked. However, Forshaw believes that due to the extensive examination of the case and its prolonged duration, it is doubtful that the sanction will be reduced.
At present, the chairman of the commission, David Phillips KC, has granted a 28-day period for Leeds, Leicester, Burnley, and Southampton to inform the commission if they wish to seek compensation from Everton’s potential new owners, 777 Partners. These clubs had previously written to Everton’s prospective owners, expressing their intention to claim damages if a guilty verdict is reached. However, it should be noted that these clubs are prohibited from pursuing legal action individually in the courts.
Chelsea and Manchester City are in a state of uncertainty regarding the Premier League’s next course of action. However, Friday’s decision has made one thing evident: there will be a heightened sense of unease in both clubs’ boardrooms.
